Cannabis seeds are not regulated under the 1961 Single Convention on Narcotic Drugs, signed in New York on March 30, 1961, amended by the Geneva Protocol of March 25, 1972, and ratified by the Spanish State.
The Single Convention establishes which part(s) of the Cannabis Sativa L. plant are regulated: the flowering or fruiting tops of the cannabis plant, as well as the resin obtained from the cannabis plant. However, it expressly excludes seeds. Seeds are excluded from the legal definition of cannabis and are not included in its annexed lists.
Cannabis Sativa L. seeds do not contain the active ingredient Delta-9 tetrahydrocannabinol (THC).
Therefore, according to the Single Convention, cannabis plant seeds are not regulated and cannot be classified as narcotics.
In Spain, the sale, possession, and personal cultivation of cannabis seeds are not considered a crime. The Spanish Penal Code classifies cannabis cultivation as a crime only when it is intended to promote, encourage, or facilitate consumption by third parties.
As ruled by the Prosecutor of the Supreme Court, Mr. Fernando Sequeros Sazatornil, the sale of cannabis seeds in quantities intended for home cultivation for personal consumption and self-supply (including seeds reproduced from them) cannot, in any way, be considered a crime.
Personal cannabis cultivation may constitute an administrative offense under Article 36.18 of Organic Law 4/2015, of March 30, on the protection of citizen security, if it is conducted in publicly visible areas.
